Referral services include connecting with third party real-estate licensees and brokers, to assist them in their search or in the sale of a property (the "Service"). In order to facilitate this Service, information, including personally identifiable information, must be collected through this Site. Henry Realty LLC offers real estate brokerage services in the licensed state of Alabama, USA. These brokerage services may be offered to a consumer as a customer or a client, as services described under Alabama law, Rule 790-X-3-, 13 (1). This form shall be presented in writing as an acknowledgement that is required by Alabama law when the issue of an exempt status due to a referral does not exist. Henry Realty LLC may also resource mortgage and lending services; as well as other third party services, to expedite the completion of (the "Service").

HENRY REALTY IS NOT A LENDER OR REAL ESTATE BROKER/AGENCY REPRESENTING YOU OR ANOTHER USER AT THIS TIME. HENRY REALTY MAY PROVIDE BROKERAGE SERVICES OR REFER YOU TO LICENSED PROFESSIONALS THAT WORK IN THE REAL ESTATE INDUSTRY TO BRING NEED TO RESOURCE PERTAINING TO THIS SERVICE.

Henry Realty LLC has a real estate license in certain states. However, Henry Realty LLC does not: (a) act as a
real estate transaction broker, listing agent or selling agent for you or any other user or provide referral services to you as a client at this time (b) represent you or another user in the purchase, sale, or exchange of real property, including any negotiation thereof; or (c) lease or rent, offer to lease or rent, or negotiate the lease of real property or otherwise aid or assist in the lease of real property. Henry Realty LLC assumes no responsibility for any result or consequence related directly or indirectly to any action or
inaction that consumers take based on the Service or any other information available through or in connection with the Service.
In connection with the Service, Henry Realty LLC is separate from other companies, the brokers and sales associates and third party affiliates that may be involved in generating business services alongside Henry Realty or from those companies and their employees or independent contractors who may be referred through Henry Realty LLC and is separate from other company's policies and their business practices.

Referrals

Users of the Service are not responsible for making referral payments to Henry Realty LLC in order to pay any referral fee. Henry Realty LLC may be paid valuable consideration in exchange for your referral to a licensed, third-party real estate broker as part of the Service. By requesting the Service, you authorize Henry Realty LLC to make such a referral and acknowledge Henry Realty LLC may be paid valuable consideration for doing so. There is no guarantee for any service. Henry Realty LLC has the right to withhold information regarding their referral network, the right to privacy, the right to not disclose or to share the unique and developed referral database information or any data pertaining to non-confidential information or confidential information shared by the Users and is the sole owner of the database. Henry Realty LLC can make in discretion changes to their database at any time without notice to anyone. Henry Realty LLC offers services through their real estate brokerage/agency office and boutique referral office and controls the use of their database. If you choose to be referred through Henry Realty LLC, you agree to then be referred by Henry Realty LLC, at the sole discretion of the licensed services that Henry Realty LLC provides.

Brokerage Services

Henry Realty LLC offers real estate brokerage services in the licensed state of Alabama, USA. These brokerage services may be offered to a consumer as a customer or a client, as services described under Alabama law, Rule 790-X-3-, 13 (1). This form shall be presented in writing as an acknowledgement that is required by Alabama law. Henry Realty LLC may decline services to anyone, at the discretion of the scope of work that fits into all federal, state, and local laws; as well as the laws that pertain to the ethics of the real estate industry, and abides by all federal Fair Housing laws. Henry Realty LLC is a boutique brokerage and referral office that values quality over quantity, as a service, and works within a specialized scope of outreach. Relationship building amongst licensed professionals is important as a service which Henry Realty LLC aims to provide. Henry Realty LLC may have licensed real estate agents of any number working out of this office. Henry Realty LLC reserves the right to disburse business services within the office or refer out to other brokerage offices and third party affiliates in order to provide (the "Service").

IN NO EVENT WILL THE AGGREGATE MAXIMUM LIABILITY OF HENRY REALTY TO YOU
FOR ANY CLAIM EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SITE
IN THE MONTH PRECEDING THE CLAIM GIVING RISE TO LIABILITY OR (B) ONE
DOLLAR ($1). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION
OF LIABILITY FOR CONSEQUENTIAL DAMAGES, ACCORDINGLY THE ABOVE LIMITATIONS

FAILS ITS ESSENTIAL PURPOSE.

Indemnity

You hereby agree to indemnify, defend, and hold harmless Henry Realty LLC against any and all claims of
losses, damages, costs, liabilities and expenses (including, without limitation, legal expenses and any
amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers)
incurred or suffered by us arising out of: (a) your access to or use of the Service; (b) any breach by you of
any provision of these Terms; (c) your violation of any law or the rights of a third party; (d) any dispute or
issue between you and any third party; (e) any User Content you upload to, or otherwise make available
through, the Service; (f) your willful misconduct; and (g) any other party’s access to and/or use of the
Services using your account and password.

Breaches of These Terms

Without prejudice to our other rights under these terms of use, if you breach these Terms in any way, we
may take such action as we deem appropriate to deal with the breach, including suspending your access to

use of this Site and our business services. If a provision of these Terms is determined by any court or other competent authority to be invalid and/or unenforceable, the other provisions will continue in effect. The invalid or unenforceable
